Please Note.  This email is between two of the authority legal officers .The slur of “blind leading the blind” seems to be clearly directed at the Chair of BBPA Planning and Rights of Way (Cllr. K. Silk) and the 24 members.

Below are  extracts  from an email draft letter between the Acting Chief Executive, the Director of Planning and the legal officer dated 14/01/09

“As a result officers had to consider whether members had been inadvertently misled during the PAROW meeting of 30th September 2008 and also whether Members had been provided with enough information to make a decision on this matter.”

 So without even asking Members for their opinions of whether they felt they were misled- the letter concludes:   -

“Officers are satisfied that Members were not inadvertently misled over the area of land to the extent that the matter needs to go back to Committee. Further officers are satisfied that the imposition of conditions restricting the area of land on which the digestate may be spread addresses the concerns raised by members during the Committee meeting.”

COMMENT: The extracts above must be very  insulting for Members. Officers are effectively telling Members what they should think at the same time as removing   their rights to make decisions and/or influence

The first statement: - If you go to  link SOLICITORS LETTER.  You need only read the concluding paragraph to be assured that members were misled by the lack of information throughout  the officers report and more specifically on land and output issues covered on pages 2, 3 &4.

NB:  Officers seem to be attempting to mislead members yet  again  re  land areas. They claim the farm has  450 acres to spread digestates over. It has far less.  This is well documented in the planning file. Spreading over fields with cattle is prohibited, there are woodlands, the 3 acre site where the plant will be   and other areas of  the farm cannot be used.
